Informed Consent
Informed Consent is a periodic paper series aimed to address current topics in health care law and policy. The goal of Informed Consent is to assist practitioners, attorneys and executives in every day practice. We hope to circulate material authored by health law experts as well as student authors on leading issues that reflect their corresponding concerns and solutions.
The first Informed Consent paper, titled "Co-Managing Your Way to Optimal Quality and Efficiency—A Guide to Clinical Co-Management Agreements," offered a practical option for aligning hospital and physician incentives. An electronic version is available here. The article outlines the reasons for Co-Management and the key steps and impediments involved in implementing a successful Co-Management arrangement.
The Annals of Health Law Editorial Board is pleased to present the second Informed Consent paper, titled "Examining Contemporary Manufacturer-Physician Consultation Agreements: The Federal Fraud and Abuse Provisions and Fair Market Valuation in Lawful Service Arrangements," which discuses how manufacturer-physician consultation arrangements potentially violate the Anti-Kickback Statute, Stark Law, and the False Claims Act if they are not structured correctly. We invite submissions from attorneys, professionals and academics in the healthcare industry who believe they have an interesting, and practical, topic they would like to share with the industry via Informed Consent.
