HRER 503: Alternative Dispute Resolution

Course Description

The use of arbitration to resolve grievances arising under collective agreements has become common practice in private, public and federal sectors. With the development of conflict management and alternative dispute resolution following a series of recent Supreme Court decisions, an increasing number of private sector employers have established mandatory and voluntary employment arbitration programs.

In addition to reviewing the evolution and development of traditional labor arbitration, this course will cover the evolution and development of the use of mandatory and voluntary arbitration in the private sector, the law related to this area and the essential elements which must exist for mandatory arbitration agreements to be enforceable in court. Students will also have the opportunity to prepare and present a mock arbitration case.
