Greetings from the Beazley Institute

Happy New Year from the Beazley Institute for Health Law and Policy at Loyola University Chicago School of Law.  We are pleased to present our first Health Law Update of 2009.  We wrapped up a busy fall semester with our Annual Symposium on Access to Health Care and we are looking forward to an exciting spring semester.  We hope to see you at one of our events in 2009.

Beazley Institute Welcomes Visiting Professors

The Beazley Institute welcomed our annual health law visiting professors on November 13, 2008.  Professor Frank Pasquale from Seton Hall Law School presented his research on regulation of specialty hospitals.  Assistant Professor Tina Piper from McGill University presented her research on historical perspectives of innovation in health care.  Loyola Visiting Professor Matthew Herder presented his research on avian flu.  Additionally, each visiting professor presented at the Symposium on Access to Health Care.

Second Annual Symposium on Access to Health Care a Success

The Annals of Health Law and the Beazley Institute hosted the Second Annual Symposium on Access to Health Care, "Perspectives on Patents and Patients:  Can They Coexist?" on Friday, November 14, 2008 at the law school.

Speakers and moderators included: Colleen Chien, Santa Clara University Law School; Victoria Espinel, George Mason University School of Law; Jorge Goldstein, Sterne, Kessler, Goldstein & Fox P.L.L.C.; Matthew Herder, Loyola University Chicago School of Law; Cynthia Ho, Loyola University Chicago School of Law; James Love, Knowledge Ecology International; Alice Martin, Barnes & Thornburg; Frank Pasquale, Seton Hall Law School; Tina Piper, McGill University; Scott Stern, Northwestern University Kellogg School of Management; and Michael Tomasson, Washington University in St. Louis.  The program included two panels, covering the past, present, and future perspectives on the role of patents in health care, and a keynote speech by James Love.  Congratulations to all those who participated and the Executive Board of the Annals of Health Law for a great event.

Filmmaker Joanna Rudnick Presents In the Family

Documentary filmmaker Joanna Rudnick visited Loyola on November 20, 2008 to present her film In the Family, which documents her personal story of genetic testing for cancer.  Ms. Rudnick shared her personal experiences with testing and the stories of other families she interviewed for her film.  Northwestern University genetic counselor Cathy Wicklund and Loyola Visiting Professor Matthew Herder joined Ms. Rudnick to answer audience questions about the laws and ethics surrounding genetic testing.  For more information about Joanna Rudnick and In the Family visit www.inthefamilyfilm.comIn the Family is a co-production of Kartemquin Films and the Independent Television Service.

Massachusetts Proposes Groundbreaking New Rules Governing Medical Device and Pharmaceutical Manufacturer Sales and Marketing Activities

The Massachusetts Public Health Council proposed regulations in December 2008 that would implement that state's new compliance law governing manufacturers of medical devices and pharmaceuticals.  In its Healthcare Update, Sidley Austin LLP details the proposal and the comment and approval process.

FDA & OHRP Guidance on Data Retention and Other Considerations Applicable to Subjects Who Withdraw from Clinical Research

Last month HHS and OHRP announced the availability of draft guidance for the withdrawal of human subjects from research.  Epstein Becker & Green, P.C.'s Client Alert provides an overview of the new guidelines.
