Another exciting semester is underway at the Beazley Institute for Health Law and Policy at Loyola University Chicago School of Law. We recently partnered with Drinker Biddle & Reath LLP to present a transactional case study designed to provide insight into an actual health law transaction. We hope to see you at one of our events before the end of this academic year!

Drinker Biddle & Reath LLP Presents First Health Law Transactional Case Study

Health care attorneys from Drinker Biddle & Reath LLP presented the Beazley Institute's first-ever health law transactional case study on Saturday, February 21. Partner Keith Anderson and Associates Melissa January and Fatema Zanzi guided more than 20 Loyola students through an actual health care transaction. Students broke into group sessions to analyze and propose solutions for several issues raised in the transaction. The event was a huge success and will become an integral part of the Institute's new focus on experiential learning and skills training in the future. Beazley Institute Welcomes Visiting Professor Leslie Francis

Leslie Francis from the University of Utah joined the Beazley Institute as a Visiting Professor on February 11-12. Dr. Francis holds appointments both as a Professor of Law and the Chair of the Department of Philosophy. During her time at Loyola she guest lectured in health law courses, met with students, and presented her current research on "Antibiotic Resistance and the Tragedy of the Commons" to faculty and students. Accepting Applications for the Beazley Institute 2009-10 LL.M. in Health Law Fellowship and 2009-10 LL.M. Degree Program

The Beazley Institute for Health Law and Policy is accepting applications for our LL.M. in Health Law Fellowship for 2009-10. While enrolled full-time in our nationally recognized LL.M. in Health Law program, the LL.M. Fellow may serve as a tutor to health care professionals enrolled in the Master of Jurisprudence in Health Law program; serve as a teaching assistant for faculty; conduct research for faculty members; author scholarly articles; contribute to the Institute's newsletter, and represent the Institute at professional meetings and associations. Compensation includes a full-tuition scholarship and a stipend. To apply, please send a writing sample, resume, and cover letter detailing health law interest and experience to:

Publications

Major Joseph Topinka, a 2008 graduate of Loyola's LLM program, recently published "Yaw, Pitch, and Roll, Quarantine Isolation at United States Airports" in 30 The Journal of Legal Medicine 51-81 (March 2009). Major Topinka is a member of the Deputy Staff Judge Advocate, United States Army Medical Command. His article explores the handling of public health risks, quarantine, and isolation at U.S. airports.

Congress Significantly Expands Federal Laws Regarding Privacy and Security of Health Information and Electronic Medical Records and Adds Substantial Medicare/Medicaid Incentives Tied to Electronic Health Records

As part of the economic stimulus package, Congress recently passed changes to health care privacy and security. On February 17, Congress adopted the Health Information Technology for Economic and Clinical Health Act. This Act, known as HIT, proposes the most significant changes to health privacy since the adoption of HIPAA. Court Narrows the Scope of False Claims Act Cases Against Subcontractors; Ruling Could Limit Claims for Medicaid Fraud

In a recent case addressing the False Claims Act, the U.S. Supreme Court heightened the standards required to hold a subcontractor liable. This decision has many implications for subcontractors and providers who receive funding from state programs that receive federal funds, including Medicaid.
