H-1B Temporary Worker
The H-1B temporary worker status allows foreign nationals to work in the United States in specialty occupations for a period of up to six years. To hire a foreign national in H-1B status, you must get approval from the Provost's Office (for a faculty hire) or from Human Resources (for a staff hire).
Unless the new employee is already in H-1B status, approval from USCIS can take up to four months. If the appointment is urgent, the hiring department may need to pay additional application fees for premium processing. For more information, please read the H-1B Application Packet (PDF).
Once you receive authorization, the prospective employee should contact OIP for help filling out the new employee portion of the application form.
Permanent Residency
For tenure track teaching faculty on the Lakeside Campuses, the Office for International Programs, Student and Scholar Services, will assist in filing forms for the first two steps in the application for Permanent Residency. These first steps are the Application for Labor Certification (Form ETA 9089) and the Immigrant Petition for Alien Worker (Form I-140). The faculty employee will be responsible for the final step, filing the Adjustment of Status Application (Form I-145).
The following is an outline of the process for assisting Loyola University Chicago faculty in applying for adjustment of status to Permanent Residency through employment.
Labor Certification, Form ETA 9089
The following is a checklist for the Hiring Department for filing of Form ETA 9089 (PERM), Special Handling for University Teaching Faculty
- Retain all of the resumes of the other candidates and provide copies to OIP.
- Retain a copy of a print advertisement and Tear Sheet from the Chronicle of Higher Education or, if you did no advertise there, a print advertisement from a national or international journal. Retain copies of any additional advertisements. These copies should include the name of the publication and dates of publication. If you
- Keep a record of the hiring process, including legal reasons that you did not hire each of the other candidates. Also, your candidate’s educational and professional qualifications for the offered position, including information about the areas in your candidate’s background that made him/her more qualified for the position than the other candidates.
- Internal notice of filing will have to be posted for 10 business days and at least 30 additional days before the filing for PERM.
- Complete the process of filing for PERM – Labor Certification for the Permanent Employment of Aliens in the United States – within 18 months of the job offer

Immigrant Petition for Alien Worker, Form I-140
- Filing the Immigrant Petition for Alien Worker is the second step in Filing for Adjustment of Status for Perm. The hiring department will pay a filing fee of $195 and provide a letter of support and employment confirmation letter. This Immigrant Petition for Alien Worker can only be filed after the ETA 9080 has been submitted to the Department of Labor and approved. Petition for Adjustment of Status (Form I-145)
- The employee will be responsible to file the Petition for Adjustment of Status to Permanent Residency. The Office for International Programs will provide general information on requirements for filing.
