Mr. Michael J. Faris is the former Local Co-Chair of the Litigation & Trial Department at Latham & Watkins LLP. He has extensive experience in complex litigation matters, with a focus on securities and professional liability litigation. He has experience in all aspects of complex cases, including fact and expert discovery, complex motions practice, and trial. Mr. Faris has argued significant motions to dismiss and for summary judgment in federal court, has conducted direct and cross examinations in large jury trials, and has conducted solo bench trials and arbitrations in smaller matters.
Mr. Faris has represented clients in securities actions, derivative suits, proxy contests, individual securities actions under both federal and state securities laws, and complex matters involving alleged director and shareholder fiduciary duty violations. He appears in both federal and state courts around the country. In addition, he has been involved in internal investigations of potential criminal conduct and represented companies under investigation by the United States Securities and Exchange Commission and/or the Department of Justice. He has also had oversight responsibility for extensive electronic document collection efforts in response to federal law enforcement subpoenas.
In addition to his securities and professional liability practice, Mr. Faris has experience in complex commercial litigation in the areas of antitrust, trademark and patent infringement, and insurance litigation.
Mr. Faris is a national board of directors member for the American Constitution Society and is admitted to the United States District Courts for the Northern District of Illinois, Eastern District of Michigan, Western District of Wisconsin, the Federal Circuit, and the Tenth Circuit Court of Appeals, and has appeared in courts in Illinois, Washington, Oregon, Arizona, Wisconsin, Michigan, Delaware, and New York.
