Shawn J. Gebhardt is Counsel in the Complex Business Litigation group at Ulmer & Berne LLP. In this role, he represents clients in class action, false advertising, mass tort, product liability, antitrust, and other complex commercial litigation. He speaks and writes on a variety of subjects, including product labeling, e-discovery issues, and technological innovation.
Mr. Gebhardt’s representative matters include securing a judgment of no liability on behalf of an auditing firm in the largest auditor professional negligence trial in history; successfully obtaining dismissal of class action claims alleging that a Fortune 100 nutritional product company’s products were falsely labeled “organic” under federal law and obtaining affirmance by the Second Circuit; defending two Fortune 500 pharmaceutical companies in mass tort litigation involving testosterone replacement therapy; prosecuting negligence and fraud claims on behalf of a Fortune 100 manufacturer of cable television set-top boxes in litigation against a supplier of defective electronic components; and representing a real estate investment manager in a breach of contract dispute with a business partner following that partner’s failure to separate pursuant to the terms of a buy/sell agreement between the parties.
Mr. Gebhardt is very active in pro bono matters and has represented numerous clients in civil rights, human rights, asylum, and personal injury litigation. Most recently, he secured asylum for a single mother fleeing persecution in the Democratic Republic of Congo. He is a co-chair of the National Immigrant Justice Center (NIJC) Junior Leadership Board.
As a law student, Mr. Gebhardt served first as a member, and then as Senior Publishing Editor, of the California Law Review. He received the Prosser Prize in Remedies and was awarded the Ralph Eltse Memorial Scholarship for his “strong record of achievement and professional promise.” He also served as a judicial extern to the Honorable Marilyn Hall Patel of the U.S. District Court for the Northern District of California and worked as a research assistant to Professor Anne Joseph O’Connell.
During his graduate studies, Shawn was appointed by Missouri Governor Bob Holden to serve as the Student Representative to the University of Missouri Board of Curators, the University of Missouri System’s governing body.
