“COVID-IP: Staring Down the Bayh-Dole Act with 2020 Vision,” Journal of Law and the Biosciences (2020)

The coronavirus pandemic provides an opportunity to reflect on the purpose and impact of the historic Bayh-Dole Act, which introduced significant changes to patent rights for publicly funded research. Patent rights for therapeutic compounds, methods of delivery, and medical diagnostics will dictate access to and cost of life-saving innovations in the fight against COVID-19. This article examines efforts urging the government to utilize governmental march-in rights to quell concerns about patent monopolization and product pricing.
