Ho directs Loyola’s Intellectual Property program. Her research includes both domestic and international intellectual property issues that intersect with health law policy. This article builds upon her past scholarship to show that the recent expansion of commercial speech case law concerning promotion of pharmaceuticals is inconsistent with cognitive biases. Ho not only provides a novel reason to cabin expansion of commercial speech, but also concludes with recommendations for broader structural reform.
